Who is Covered?

Employers

Covered

  • Businesses, state and federal governmental agencies
  • Businesses that issue 1099-MISC tax forms for more than 50% of its workforce
  • Charter schools, except for Horace Mann Charter Schools

Not Covered

  • Employers excluded under Section 6 of the unemployment statute
  • Municipalities, districts, political subdivisions, and other agencies may opt in

Employees

Covered

  • Employees who are covered by the state unemployment insurance law
  • State employees
  • Domestic workers
  • Some contract workers may be automatically covered, all other self-employeed individuals may opt in

Not Covered

  • Local government employees are not automatically covered unless their employer opts in
  • H-2A visa holders

Types of Leave

Family

Up to 12 weeks in any benefit year for birth/bonding with a new child


Up to 12 weeks to care for a family member with a serious health condition

Military

Up to 12 weeks managing affairs while a family member is on active duty.


Up to 26 weeks care for family member who was injured in the armed forces

Medical

Up to 20 weeks in any benefit year for covered individual's own serious health condition, including pregnancy/ childbirth 

Cumulative Limit: Most covered employees are eligible for up to 26 weeks of combined family and medical leave per benefit year

Benefit amount: 80% of a worker’s average weekly wage up to half of the state average, plus 50% of a worker’s average weekly wage above half of the state average

Maximum weekly benefit  = $1,129.82 in 2023
Contribution Rate: 0.63% on eligible employee wages
